Quitclaim by Henry de Acellis to Thomas de Newburgh, Earl of Warwick, of all the assarts made in Sutton Coldfield (Warw) before 1 November 1240, except for common pasture for his animals and cattle, and those of his heirs and his tenants, with free access to these and other assarts when the crops have been carried. The earl will make assarts only in certain places; he quitclaims to Henry, his heirs and their tenants 3 days' service annually due to him in his chase, and give Henry an assart to hold at an annual rent of 20d.

Hec est finalis conventio facta in crastino Animarum anno regni regis Henrici filii regis Johannis vicesimo quinto apud Coventre, inter Thomam comitem de Warr' et henricum de Acellis, videlicet quod idem Henricus quieta clamavit eidem comiti et heredibus suis omnia essarta que fecit et que facta sunt in Sutton', usque ad festum Omnium Sanctorum anno predicto: assarta que Willelmus de Ebriteston', Johannes le ferrur, Adam de Berhull', Simon de Bereford [et] Johannes Coket fecerunt in Breclinrste et in Blakemor, et que Simon alias Simonio fecit inter Langeley et Hanekesciestrete, et que Walterus Fundu, Ricardus le forester, Willelmus de Covintre, Robertus Cleed, Galfridus de Warmeley [et] Johannes pistor fecerunt in Wyttemor. Et predictus comes et heredes sui predictum assartum cum omnibus pertinenciis suis predicto Henrico et heredibus suis et eorum assignatis warrantizabunt et defendent contra omnes gentes. Et sciendum quod dictus Henricus satisfaciet Henrico persone de Wyshawe de predicto assarto, qui portavit brevem super comuna (pastorum primoc) postea predictorum essartorum. Hec concordia facta est salva predicto Henrico et heredibus suis et hominibus suis et persone de Wyshaw communa ad propria alia sua in bosco predicti comitis ut in [ille de] persona, et herbagio sicut prius habere consueverunt. . This is the final agreement made the day after All Souls in the 25th year of the reign of King Henry son of King John at Coventry, between Thomas, Earl of Warwick, and Henry de Acellis, namely that the said Henry quitclaims the said Earl and his heirs for all the assarts which he has made or which have been made or which have been made in Sutton up to the feast of All Saints in the said year: the assarts which William of Ebriteston, John the Farrier, Adam of Berhull, Simon of Bereford (Barford) and John Coket made in Breclinrste and Blakemor; and which Simon alias Simonio made between Langeley and Hanekesciestrete (?Hawksnest); and which Walter Fundu, Richard the Forester, William of Coventry, Robert Cleed, Geoffrey of Walmley, and John Baker made in Wyttemor. On condition that the said Henry and his heirs henceforth shall be able to take nothing in the said assarts unless the same amount of common of pasture is given for all his animals and flocks and those of his tenants, except goats, with freedom to come and go into them and other assarts in the town (except the assarts of Simon son of Simon and Simon de Bereford) when the crops are growing in them have been carried away both blade and straw. And the said Earl shall by no means make assarts or clearings from Wylner Desley to Ravennsley between Wyshawe and the far side of Hawksnest, except Langeley Knolles to the use of the said Earl and his heirs, 6½ acres to the use of Margaret daughter of William Clement, 10 acres to the use of William del Hull, 4½ acres to the use of William of the Park, 6 acres to the use of Alexander of Cruddeworth (Curdworth), 10 acres to the use of Nicholas of Cruddeworth, and 4 acres to the use of Walter of Bereford. And in view of this quitclaim, the said Earl releases the said Henry and his heirs and tenants from 3 days service per year owed to him in his Chase, that is to say one day in each of his Chases. And he gives the said Henry all of his assart in Burhale (?Burrels) next to the assart of Walter of Bereford enclosed between the two great roads leading towards Langeley (?Bulls Lane and Ox Leys Road). To have and to hold to the same Henry and his heirs and assigns from the said Earl and his heirs freely and quietly well and peacably and with right of inheritance for ever. Paying rent for the same to the said earl and his heirs 20 pence at two terms, namely at Lady Day 10d and at Michaelmas 10d for all services, customs, suits of court and other claims. And the said Earl and his heirs will warrant and defend the said assart with all its appurtenances for the said Henry his heirs and assigns against all comers. And be it known that the said Henry is to satisfy Henry the Parson of Wyshawe about the said assart, who has a writ for common of pasture after the said assart. This agreement has been made as a saving clause for the said Henry and his heirs and followers and the Parson of Wyshaw so that the rights of common of pasture in the woods of the said Earl and in theat of the parson may be had as they were previously had, and also the herbage; andso that this agreement and quitclaim may be ratified and firm and last for ever, these present writings have been made in the form of a chirograph and the said Earl Thomas and Henry alternately affixed their seals. Acknowledgement by Walter of Barford (Warw) that if Simon de Acellis and Henry the Parson of Wishaw (Warw) make any claim (concering common rights) against Thomas de Newburgh, Earl of Warwick, because of his leasing 2 acres in Sint' to him (Walter), then he, and not the Earl, will pay any compensation due to them.

Know all men present and to come that I Walter of Bereford and my heirs will discharge any claims made against Lord Thomas Earl of Warwick and his heirs by Simon de Acellis and his heirs and by Henry the Parson of Wytsawe for ever if it should happen that any damages occur through the taking in of two acres of land in Sint (?Sutton) which the said Walter had from the said Earl in the 26th year of the reign of King Henry son of King John, next to the close of Simon of Bereford below Hynstebrok (?Hurstbrook) on the west side. Further, the said Walter and his heirs will preserve and warrant and indemnify the said Earl and his heirs against the said parties for ever. In witness whereof I apply my seal to these presents. Witnesses: Lord John Worwassall, Lord Henry of Lodbrok, William of Bereford, Simon son of Simon, Truston of Sileb, William of Britest, Thomas of Gatemore, John Farrier and others.
